Terms of Service

Introduction and Acceptance of Terms
These Terms of Service ("Terms") constitute a legally‑binding agreement between you ("you" or "User") and Infinite Epigenetics, Inc. ("Infinite," "Company," "we," or "us"). They govern your access to and use of the Infinite mobile application, website, membership program, epigenetic test kits, and any related content or support we provide (collectively, the "Service").By (a) joining our waitlist, (b) purchasing a membership, (c) creating an account, or (d) otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Service.Binding Effect for Organizations. If you use the Service on behalf of a business or other legal entity, you represent that you have authority to bind that entity, and "you" will refer to the entity.
Definitions
For ease of reference some key terms are defined below. Capitalized terms not defined here have the meaning given elsewhere in these Terms.
"Account Credentials" – your username, password, and any multifactor‑authentication token associated with your Infinite account.
"App" – the Infinite mobile application and web portal.
"Content" – text, graphics, reports, software, audio, video, and all other materials made available through the Service.
"Epigenetic Information" – laboratory‑derived data regarding methylation markers in your DNA, generated from a blood sample you provide.
"Membership" – the paid subscription that grants access to quarterly epigenetic test kits and personalized lifestyle recommendations.
"Personal Information" – information that identifies or could reasonably identify you, including Registration Information, Epigenetic Information, and health or lifestyle data you submit.
"Registration Information" – information you provide when creating or updating an account (e.g., name, email, payment details, shipping address).
Eligibility and User Representations
You represent and warrant that:
1. You are at least 18 years old (or the age of majority in your jurisdiction).
2. Any blood sample you submit is your own and was collected in accordance with applicable laws.
3. All information you provide is true, accurate, current, and complete and you will promptly update it as needed.
4. You will maintain the confidentiality of your Account Credentials and are responsible for all activity under your account.
5. You are not accessing the Service as an insurer, employer, or for any discriminatory purpose.
Description of the Service
Infinite provides a consumer wellness program that combines quarterly epigenetic testing with AI‑generated lifestyle guidance.
A Membership includes:
One (1) Infinite epigenetic test kit per quarter.
Secure laboratory processing of your blood sample.
Personalized reports and lifestyle recommendations delivered through the App.
Ongoing access to prior results and comparative tracking tools.
We continuously improve our algorithms and may add, remove, or modify features without prior notice. Where a change materially reduces core functionality, we will provide reasonable advance notice.
User Conduct – Unlawful and Prohibited Uses
You may only use the Service for personal, non‑commercial wellness purposes.
You agree not to:
Violate any law or regulation.
Reverse‑engineer, decompile, or disassemble any part of the App.
Upload viruses, malicious code, or content you do not have the right to transmit.
Harvest or scrape data, interfere with servers, or bypass security measures.
Infringe intellectual‑property or privacy rights.
Use the Service to harass, abuse, or defame any person.
We reserve the right to suspend or terminate accounts involved in prohibited conduct.
Health and Wellness Disclaimer (Not Medical Advice)
All Content, including AI‑generated suggestions, is provided for informational and educational purposes only and is not medical advice. Infinite is not a medical organization and does not diagnose, treat, or cure disease. Always consult a qualified healthcare professional before making significant lifestyle or dietary changes or if you have questions about a medical condition. You assume full responsibility for all decisions made using the Service.
Membership, Fees, and Automatic Renewal
1. Membership Fee. Membership fees are displayed at checkout and are billed every three (3) months (quarterly) plus applicable taxes.
2. Automatic Renewal. Your membership renews automatically each quarter until cancelled as provided below. We will notify you by email or in‑App message at least 14 days before a renewal charge.
3. No Refunds for Current Term. All sales are final once a quarterly fee is charged. You may turn off auto‑renew to avoid future charges, but amounts already paid are non‑refundable.
4. Cancelling Renewal. To cancel renewal you must (a) toggle "Cancel Auto‑Renew" in Settings or (b) email concierge@infiniteepigenetics.com before the last day of your current term.
5. Payment Failures. If a transaction is declined we may suspend access until payment is successful. You are responsible for bank fees, currency conversion, or similar charges.
6. Price Changes. Membership fees may change for future terms. We will notify you in advance.
Intellectual Property
All content, materials, and services provided are owned by Infinite Epigenetic. Unauthorized reproduction, distribution, or use of our content is prohibited.
Data Security and Privacy
Our Privacy Policy describes how we collect, use, and share Personal Information.
Key points:
We use your information to operate the Service, personalize recommendations, and improve our algorithms.
We do not sell your Epigenetic Information.
We may create de‑identified data and aggregate statistics for internal research and product development.
You can delete your account and request data deletion as described in the Privacy Policy, subject to legal retention obligations.

Communications & Consent
By creating an account, joining the waitlist, purchasing a membership, or otherwise using the Services, you consent to receive communications from Infinite Epigenetics electronically—including via email, SMS/text message, push notification, and in‑app message. These communications may cover transactional or administrative matters (for example, order confirmations, security alerts, account or feature changes) as well as legal notices (such as updates to these Terms or to our Privacy Policy). With your opt‑in, they may also include marketing or promotional content.
You agree that electronic communications from us satisfy any legal requirement that such communications be in writing. You may opt out of promotional emails or texts at any time by following the unsubscribe instructions in those messages or by adjusting your communication preferences in the app. Opting out of promotional messages will not limit our right to send you transactional or legally required notices.
Intellectual‑Property Rights
The Service and all Content are owned by Infinite or its licensors and are protected by copyright, trademark, and other laws. We grant you a revocable, non‑exclusive, non‑transferable license to use the App and Content solely for personal, non‑commercial purposes in accordance with these Terms. You may download or print reports for your own use. All other rights are reserved."Infinite Epigenetics," "Infinite," and related logos are trademarks of the Company. You may not use our marks without prior written consent.
Sample Collection, Processing Risks, and Service Limitations
Laboratory processing may fail for technical reasons. If two (2) attempts to process your sample are unsuccessful, we will either (a) send another kit at no extra charge, or (b) issue a full refund of the quarterly fee related to that sample, at our discretion.
Epigenetic science is evolving and recommendations may change as new research emerges.
Individual outcomes vary; we do not guarantee any specific health or wellness result.
Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR‑FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT IS ACCURATE OR COMPLETE.
Limitation of Liability
WITHIN THE LIMITS ALLOWED BY APPLICABLE LAW, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT INFINITE EPIGENETICS, INC. AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF INFINITE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) AND REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, WARRANTY, TORT — INCLUDING NEGLIGENCE — STRICT LIABILITY, PRODUCT LIABILITY, OR OTHERWISE).
Without limiting the foregoing, Infinite shall not be liable for any damages arising from or related to:
(a) your use of or inability to use the Service;
(b) any action or decision you take based on information obtained through the Service;
(c) unauthorized access to or alteration of your transmissions or data;
(d) your failure to maintain the confidentiality of Account Credentials;
(e) the cost of procurement of substitute goods or services;
(f) statements or conduct of any third party on or through the Service;
or (g) the improper authorization or use of the Service by anyone claiming to act on your behalf.
If, notwithstanding the above, Infinite is found liable for any damage or loss, our total liability to you for all claims will not exceed the greater of: (1) the total fees you paid (if any) for access to the Service in the twelve (12) months before the event giving rise to the claim, or (2) US $100.
Indemnification
You agree to indemnify, defend, and hold harmless Infinite, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any law or the rights of a third party.
Indemnification
You agree to indemnify, defend, and hold harmless Infinite, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any law or the rights of a third party.
Changes To Terms
We may modify the Service or these Terms at any time. For material changes, we will provide advance notice via the App or email. The updated Terms will be effective on the stated "Last Updated" date. Your continued use after that date constitutes acceptance. If you do not agree, you must stop using the Service and cancel auto‑renew before the next billing cycle.
Termination
You may stop using the Service at any time. We may suspend or terminate your access immediately if you breach these Terms, fail to pay fees, or engage in fraudulent or unlawful activity. All provisions that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, and Dispute Resolution) will survive.
Governing Law
These Terms are governed by the laws of the Commonwealth of Kentucky, USA, without regard to conflict‑of‑laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Dispute Resolution and Arbitration Agreement
1. Informal Resolution. Please contact concierge@infiniteepigenetics.com to attempt to resolve any dispute before commencing formal proceedings.
2. Binding Arbitration. If a dispute is not resolved within 30 days, either party may initiate binding arbitration administered by JAMS under its Streamlined Rules. Arbitration will be conducted in Fayette County, Kentucky, or by secure video conference. The Federal Arbitration Act governs interpretation and enforcement.
3. Class‑Action Waiver. All proceedings shall be on an individual basis; class, consolidated, or representative actions are not permitted.
4. Opt‑Out. You may opt out of arbitration by emailing concierge@infiniteepigenetics.com within 30 days of first accepting these Terms.
5. Small‑Claims Exception. Either party may bring an individual action in small‑claims court for disputes within that court’s jurisdiction.
6. Time to File. Any claim must be filed within one (1) year after it arose or be forever barred.
If the arbitration clause is found unenforceable, exclusive jurisdiction and venue will be in the state or federal courts located in Fayette County, Kentucky, and each party waives jury trial to the extent permitted by law.
Miscellaneous
Entire Agreement. These Terms and the Privacy Policy constitute the entire agreement between you and Infinite regarding the Service and supersede any prior agreements.
No Waiver. Our failure to enforce any right is not a waiver of future enforcement.
Severability. If any provision is held invalid, the remainder of the Terms will remain in effect.
Assignment. You may not assign your rights or obligations under these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
Force Majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
